Términos y Condiciones de Venta.
INFORMACIÓN PREVIA A LA CONTRATACIÓN
Las presentes condiciones generales (las “Condiciones Generales”), junto con, en su caso, las condiciones particulares que pudieran establecerse (las “Condiciones Particulares”), regulan expresamente el acceso, uso y relaciones comerciales entre el usuario (el “Cliente”) y el punto de venta Mesabliss Nautica (el “Punto de Venta”) a través del cual se formaliza la compra de los productos ofrecidos durante su período de disponibilidad (los “Productos”) mediante la plataforma de comercialización accesible a través del sitio web www.mesablissnautica.com (el “Canal Online”), titularidad de Erasmus Expo S.L., con CIF B56193147 y domicilio social en Av. Meridiana 350, 11 D, 08027 Barcelona. La sociedad se encuentra inscrita en el Registro Mercantil de Barcelona, Tomo 48905, Folio 134, Hoja B600438, Inscripción 1ª.
Las presentes Condiciones Generales permanecerán en vigor y serán válidas durante todo el tiempo en que se encuentren accesibles a través del Canal Online. Erasmus Expo S.L. se reserva el derecho de sustituir, en cualquier momento, tanto las Condiciones Generales como las Condiciones Particulares (las “Nuevas Condiciones”), así como todos aquellos avisos legales, directrices y/o reglamentos de uso contenidos en el Canal Online que, según el caso, sustituyan, complementen y/o modifiquen las presentes Condiciones Generales. El Cliente quedará sujeto a las Condiciones Generales vigentes en el momento de realizar su pedido. Su vigencia temporal coincidirá con el período de su publicación, hasta que sean modificadas total o parcialmente. Las Nuevas Condiciones serán de aplicación desde el momento en que se pongan a disposición del Cliente.
En caso de contradicción entre los términos y condiciones recogidos en las presentes Condiciones Generales y las Condiciones Particulares, prevalecerán siempre las condiciones acordadas en este último documento respecto de aquellos términos incompatibles, y únicamente respecto de aquellos Productos sometidos a dichas condiciones específicas. 1. PARTES
Tendrán la consideración de “Cliente” aquellos consumidores personas físicas residentes en territorio español peninsular e insular (con excepción de Ceuta y Melilla) que sean mayores de edad y dispongan de Documento Nacional de Identidad (D.N.I.) o Número de Identificación de Extranjero (N.I.E.), así como aquellas personas jurídicas que acrediten adecuadamente su condición y acepten las presentes Condiciones Generales y las Condiciones Particulares que, en su caso, resulten aplicables. Queda expresamente prohibida la compra de Productos en el Canal Online de Mesabliss Nautica por parte de menores de edad, usuarios que no residan legalmente en España o usuarios que no cumplan los requisitos establecidos en las presentes Condiciones Generales.
El “Punto de Venta” será la entidad titular del establecimiento elegido por el Cliente al formalizar su pedido, y será con quien se entenderá celebrada la compraventa de los Productos solicitados. Los datos societarios de cada uno de los Puntos de Venta responsables de la venta serán debidamente identificados durante el proceso de contratación.
2. ACCESO Y USO DEL CANAL ONLINE
El acceso y uso del Canal Online tiene carácter libre y gratuito, reservándose Mesabliss Nautica el derecho de exigir en el futuro una contraprestación económica por ello. Para la compra de Productos a través del Canal Online, Mesabliss Nautica solicitará a los usuarios que procedan a registrarse, debiendo dichos Clientes cumplimentar el formulario electrónico que aparezca en cada momento en el Canal Online, siguiendo las instrucciones indicadas en el mismo. Durante dicho proceso de registro deberán facilitarse única y exclusivamente datos exactos y veraces. Mesabliss Nautica enviará a la dirección de correo electrónico designada por el Cliente la correspondiente confirmación de registro.
El nombre de usuario y la contraseña constituyen elementos habilitadores para acceder y efectuar compras, teniendo carácter confidencial, personal e intransferible. El nombre de usuario no podrá ser modificado por el Cliente, si bien la contraseña sí podrá modificarse, en cuyo caso las claves anteriores perderán su validez.
El Cliente será responsable de la adecuada custodia y confidencialidad de su contraseña, no pudiendo ceder su uso a terceros, ya sea de forma temporal o permanente, ni permitir en ningún caso su utilización por terceros. El Cliente deberá comunicar inmediatamente a Mesabliss Nautica cualquier acceso no autorizado al Canal Online realizado mediante el uso de su contraseña.
Todas las adquisiciones de Productos realizadas a través del Canal Online, previa identificación y autenticación mediante el nombre de usuario y contraseña facilitados, se considerarán válidamente efectuadas por el Cliente y tendrán carácter vinculante. En consecuencia, el Cliente será el único responsable de cualesquiera compras realizadas por terceros mediante el uso de sus datos de acceso y contraseña. La realización de pedidos a través del Canal Online por parte de un menor de edad que falsee los datos de registro se entenderá realizada bajo la supervisión y autorización de sus padres, tutores o representantes legales.
La utilización del Canal Online y/o la contratación de cualquiera de los Productos implica la aceptación, por parte del Cliente y sin reserva alguna, de todas y cada una de las presentes Condiciones Generales y, en su caso, de las Condiciones Particulares aplicables. En caso de no aceptar las presentes Condiciones Generales, las Condiciones Particulares y/o las Nuevas Condiciones, el usuario deberá abstenerse de acceder y/o utilizar el Canal Online. La puesta a disposición y utilización del Canal Online por parte del Cliente se entenderá, en todo caso, supeditada al estricto cumplimiento de las presentes Condiciones Generales y, en su caso, de las Condiciones Particulares aplicables.
La relación jurídica derivada del registro como Cliente del Canal Online tendrá duración indefinida. Cualquiera de las partes podrá resolver o suspender unilateralmente la presente relación contractual en cualquier momento y sin necesidad de alegar causa distinta de su mera voluntad, sin perjuicio de las obligaciones derivadas de pedidos formalizados con anterioridad a la terminación de la relación. El Cliente podrá ejercer unilateralmente su derecho de resolución mediante el procedimiento de cancelación de cuenta.
3. INFORMACIÓN Y DISPONIBILIDAD DE LOS PRODUCTOS OFRECIDOS
Los Productos ofrecidos en el Canal Online, junto con sus características esenciales y precio, aparecerán en pantalla. Además del precio, y antes de la confirmación del pedido, se mostrarán los posibles gastos de envío al domicilio del Cliente.La aplicación de los gastos de envío dependerá del importe total y del peso del pedido. Las ofertas estarán debidamente identificadas en pantalla.
El Punto de Venta se reserva el derecho de decidir, en cada momento, los Productos incluidos y ofrecidos a través del Canal Online. En consecuencia, podrá añadir en cualquier momento nuevos Productos a los ya incluidos en el Canal Online, entendiéndose, salvo disposición en contrario, que dichos nuevos Productos quedarán sujetos a las Condiciones Generales vigentes en ese momento. Asimismo, el Punto de Venta se reserva el derecho de retirar o dejar de ofrecer, en cualquier momento y sin previo aviso, cualesquiera Productos ofrecidos en el Canal Online.
Por cada operación de compra podrá realizarse un pedido sin límite máximo de unidades de un mismo producto.
Todos los pedidos y compras realizados a través del Canal Online estarán sujetos a la disponibilidad efectiva de stock de los Productos en el momento de preparación del envío. En caso de que alguno de los Productos solicitados no estuviera disponible, Mesabliss Nautica contactará con el Cliente para informarle, pudiendo éste optar entre recibir el pedido con los productos disponibles o cancelar íntegramente el pedido.
4. PRECIOS Y GASTOS DE ENVÍO
Los precios de los Productos se mostrarán siempre en euros e incluirán el IVA y cualesquiera otros impuestos que resulten aplicables, siendo en todo momento los vigentes. En determinados casos, los precios de los Productos podrán mostrarse tanto con IVA incluido como sin IVA incluido. Si Mesabliss Nautica o el Punto de Venta detectasen un error manifiesto en el precio de los Productos, informarán al Cliente, quien tendrá la opción de reconfirmar su pedido al precio correcto o, en su defecto, cancelarlo.
El precio de los Productos no incluye los gastos de envío. Dependiendo del importe total del pedido, dichos gastos correrán a cargo del Cliente y se añadirán al importe total de los Productos seleccionados.
El sitio web indicará claramente los gastos de envío que deban ser asumidos por el Cliente. El Cliente será debidamente informado de dichos costes antes de efectuar el pago, antes de confirmar el pedido y antes de finalizar el proceso de contratación.
Los precios mostrados en el Canal Online serán aplicables exclusivamente a los Productos ofrecidos a través de dicho Canal y durante el tiempo en que permanezcan publicados. Mesabliss Nautica se reserva expresamente el derecho de modificar los precios en cualquier momento y sin previo aviso. No obstante, en todo caso serán de aplicación las tarifas vigentes indicadas en el Canal Online en el momento de realización del correspondiente pedido. Los precios publicados en el Canal Online podrán diferir de los precios aplicados a los mismos Productos en establecimientos físicos pertenecientes a la red de distribución de Mesabliss Nautica.
5. PROCESO DE COMPRA
Para proceder a la compra de Productos, el Cliente deberá añadir el producto deseado a la Cesta de Compra, siguiendo las indicaciones mostradas en pantalla y cumplimentando el formulario de pedido correspondiente.
Una vez efectuada la compra, se solicitarán los datos necesarios para el envío y la facturación, así como los datos y métodos de pago. Formalizada la compra, se remitirá al Cliente, a la dirección de correo electrónico facilitada al efecto, una confirmación de la compra realizada que servirá como justificante de la operación (“Justificante de Compra”).
Asimismo, el Cliente podrá consultar y/o descargar la factura en el apartado “Mis Pedidos”. La confirmación del pedido y el Justificante de Compra no tendrán validez como factura. La compra se entenderá realizada en el domicilio social de Mesabliss Nautica.
6. FORMA DE PAGO
Para proceder al pago, el Cliente deberá seguir todas las instrucciones que aparezcan en la correspondiente página del Canal Online. El pago del precio de los Productos y de los gastos de envío únicamente podrá realizarse mediante tarjeta de crédito, tarjeta de débito u otros métodos de pago indicados en cada momento en la correspondiente página. Dichos medios de pago estarán sujetos a comprobaciones y autorizaciones por parte de las entidades emisoras. En caso de que la entidad emisora no autorice el pago, no podrá continuarse con el procedimiento de compra iniciado, quedando automáticamente cancelado el pedido y entendiéndose no realizada la compraventa del Producto o Productos solicitados.
El cargo correspondiente al precio de los Productos, a los costes del servicio de envío —en su caso— y a los impuestos aplicables se efectuará en el momento de formalización del pedido. Como sistema de pago electrónico, Mesabliss Nautica y los Puntos de Venta disponen de una pasarela de pago de comercio electrónico de Shopify. Todos los datos facilitados a Mesabliss Nautica y a los Puntos de Venta para estos fines se encuentran cifrados con el fin de garantizar la máxima seguridad y se alojan en un servidor seguro certificado conforme al protocolo “Secure Socket Layer” (SSL).
En ningún caso se almacenarán los datos facilitados por los Clientes a través de la pasarela de pago, conservándose únicamente durante el tiempo necesario para la realización de la compra, la gestión del pago y hasta la finalización del período de desistimiento. Mesabliss Nautica y los Puntos de Venta se reservan el derecho de cancelar el nombre de usuario y la contraseña y, por tanto, el acceso al Canal Online, de aquellos usuarios que mantengan saldos deudores o impagos con cualquier Punto de Venta.

PRE-CONTRACTUAL INFORMATION
These general conditions (the “General Conditions”), together with any special conditions that may be established (the “Special Conditions”), expressly regulate the access, use, and commercial relations between the user (the “Customer”) and the Mesabliss Nautica point of sale (the “Point of Sale”) through which the purchase of products offered during their period of availability (the “Products”) is formalized via the marketing platform accessible on the website www.mesablissnautica.com (the “Online Channel”) owned by Erasmus Expo S.L., with CIF B56193147 and registered office at Av. Meridiana 350, 11 D, 08027 Barcelona. The company is registered in the Mercantile Registry of Barcelona, Volume 48905, Folio 134, Page B600438, 1st Inscription.
These General Conditions shall remain in force and be valid for as long as they are accessible through the Online Channel. Erasmus Expo S.L. reserves the right to replace at any time both the General Conditions and the Special Conditions (the "New Conditions"), as well as all legal notices, guidelines, and/or usage regulations gathered in the Online Channel which, depending on the case, will replace, complete, and/or modify the General Conditions set forth herein. The Customer shall be subject to the General Conditions in force at the time of placing their order. Their temporal validity coincides with the time of their display, until such time as they are totally or partially modified. The New Conditions will apply from the moment they are made available to the Customer.
In the event of a contradiction between the terms and conditions expressed in these General Conditions and the Special Conditions, the conditions agreed upon in the latter instrument shall always prevail regarding those incompatible terms, and only with respect to those Products subject to said specific conditions. 1 PARTIES.
"Customer" shall be considered those consumers who are natural persons residing in the Spanish peninsular and insular territory (with the exception of Ceuta and Melilla) who are of legal age and possess a National Identity Document (D.N.I) or Foreigner Identification Number (N.I.E), or legal entities that adequately prove their status and accept these General Conditions and the Special Conditions that, where applicable, may apply. The purchase of Products on the Mesabliss Nautica Online Channel by minors, users who do not legally reside in Spain, or by users who do not meet the requirements provided in these General Conditions is expressly prohibited.
The “Point of Sale” shall be the entity that owns the establishment chosen by the Customer when formalizing their order, and shall be the party with whom the sale and purchase of the requested Products is deemed to have been concluded. The corporate data of each of the Points of Sale responsible for the sale will be duly identified during the contracting process.
2 ACCESS AND USE OF THE ONLINE CHANNEL.
Access to and use of the Online Channel is free of charge, although Mesabliss Nautica reserves the right to demand compensation for it in the future. For the purchase of Products through the Online Channel, Mesabliss Nautica will request that users register, for which purpose said Customers must complete the electronic form that appears on the Online Channel at any given time, following the instructions indicated therein. During this registration process, only accurate and true data must always be provided. Mesabliss Nautica will send confirmation of the registration to the email account designated by the Customer for this purpose.
The username and password are enabling elements for accessing and making purchases and are confidential, personal, and non-transferable. The username may not be modified by the Customer, but the password may, in which case the modified keys will lose their validity. The Customer shall be responsible for the proper custody and confidentiality of the password, and may not assign its use to any third party, whether temporary or permanent, nor allow its use by any third party under any circumstances. The Customer must immediately notify Mesabliss Nautica of any access to the Online Channel that any third party other than the Customer may perform using their password.
All acquisitions of Products purchased through the Online Channel, following identification and authentication via the username and password provided, will be considered validly performed by the Customer and will be binding. Consequently, the Customer shall be exclusively responsible for any purchases of Products through the Online Channel by any third-party making use of their data and password. The placement of orders from the Online Channel by a minor who falsifies registration information shall be understood to be carried out under the supervision and authorization of their parents, tutors, or legal representatives.
The use of the Online Channel and/or the contracting of any of the Products implies acceptance as a Customer, without reservations of any kind, of all and each of the General Conditions as well as, where applicable, the Special Conditions that may apply. If you decide not to accept these General Conditions, the Special Conditions, and/or, where applicable, the New Conditions, you must refrain from accessing and/or using the Online Channel. The availability and use of the Online Channel by the Customer shall be understood, in any case, to be subject to strict compliance by the latter with the terms set forth in these General Conditions and, where applicable, in the resulting Special Conditions.
The legal relationship derived from registration as a Customer of the Online Channel has an indefinite duration. Either party may terminate or suspend this contractual relationship unilaterally at any time and without any cause other than their will to do so, without prejudice to the obligations derived from the formalisation of orders prior to the termination of the relationship. The Customer may unilaterally exercise the right of termination through the account cancellation process.
3 INFORMATION AND AVAILABILITY OF OFFERED PRODUCTS.
The Products offered on the Online Channel, along with their essential characteristics and price, will appear on the screen. Apart from the price, and before confirming the order, any possible shipping costs to the Customer's home will appear on the screen. The application of shipping costs will depend on the total amount and weight of the order. Offers will be duly indicated on the screen.
The Point of Sale reserves the right to decide at any time which Products are contained and offered to Customers through the Online Channel. Thus, the Point of Sale may at any time add new Products to those included in the Online Channel, it being understood, unless otherwise provided, that such new Products shall be governed by the provisions of the General Conditions in force at that time. Furthermore, the Point of Sale reserves the right to withdraw or stop offering, at any time and without prior notice, any Products offered on the Online Channel.
For each purchase operation, an order may be placed without a maximum number of units of the same product. All orders and purchases made through the Online Channel are subject to the effective availability of stock of the Products at the time the shipment is prepared for delivery. If any of the Products in your order are not available, Mesabliss Nautica will contact the customer to inform them, and the customer may choose between receiving the order with the available products or cancelling the entire order.
4 PRICES AND SHIPPING COSTS.
Product prices are always shown in euros and will be subject to VAT and any other applicable taxes, and will be those in force at all times. In some cases, Product prices are also shown both including and excluding VAT. If Mesabliss Nautica or the Point of Sale identifies a manifest error in the price of the Products, they will inform the Customer, who will have the option to reconfirm their order at the correct price or, failing that, cancel it.
The product price does not include shipping costs. Depending on the total amount of the order, shipping costs are borne by the Customer and will be added to the total amount of the selected Products. The website clearly indicates which shipping costs must be paid by the Customer. The Customer will be duly informed of these costs, which will be specified before payment, before confirming the order, and before finalizing the contracting process.
The prices shown on the Online Channel apply exclusively to the Products offered through said Channel and for the time they remain published. Mesabliss Nautica expressly reserves the right to modify prices at any time without prior notice. Nevertheless, in any case, the rates in force indicated on the Online Channel at the time of placing the corresponding order will be applied. Prices published on the Online Channel may differ and be distinct from the prices of the same Products offered and sold in the establishments of the Mesabliss Nautica distribution network for direct purchase in said establishments.
5 PURCHASE PROCESS.
To proceed with the purchase of Products, you must add the product you wish to acquire to the Shopping Basket, according to the indications on the screen, completing the order form provided for this purpose. Once the purchase is made, the necessary data for shipping and billing will be requested. As well as the payment data and methods. Once the purchase is formalized, a confirmation of the purchase made will be sent to the email address indicated for this purpose by the Customer, which will serve as proof of the operation ("Proof of Purchase").
Furthermore, the customer may consult and/or download the invoice in the "My Orders" area. The order confirmation and the Proof of Purchase shall not be valid as an invoice. The purchase shall be deemed to have been made at the domicile of Mesabliss Nautica.
6 PAYMENT METHOD.
To proceed with the payment, the Customer must follow all instructions shown on the corresponding page of the Online Channel. Payment of the price of the Products and shipping costs may only be made by credit or debit cards or other forms of payment indicated on the corresponding page at any given time. These payment methods will be subject to checks and authorizations by the issuing entities; if said entity does not authorize the payment, the initiated purchase procedure cannot continue, the order being automatically cancelled, and the sale of the requested Product or Products deemed not to have taken place.
The charge for the price of the Products, the shipping service costs—where applicable—as well as any resulting taxes, will be made at the time of formalizing the order. As an electronic payment system, Mesabliss Nautica and the Points of Sale have a Shopify electronic commerce payment gateway installed. All data provided to Mesabliss Nautica and the Points of Sale for these purposes are encrypted to ensure maximum security. They are hosted on a secure server certified according to the "Secure Socket Layer" (SSL) protocol.
Under no circumstances will the data provided by Customers through the payment gateway be stored, and they will only be kept while the purchase is being made, the payment is being processed, and until the withdrawal period has elapsed. Mesabliss Nautica and the Points of Sale reserve the right to cancel the username and password, and therefore access to the Online Channel, of those users who maintain debtor or unpaid balances with any Point of Sale.
